项目摘要

本年度の研究実績は、主に以下の2点に整理することができる。まず第1に、予防原則の法規範性の特性について、国連海洋法裁判所のみなみまぐろ事件暫定措置命令の分析を出発点に、従来の学説の批判的検討を行った。その結果、「準則」ではなく「原則」としての予防概念の1つの特性が、国家の行動を直接規律する「行為規範」としての性質ではなく、そうした行為規範の発展や調整の局面において作用する「決定規範」としての性質に見出すことができることを明らかにした。第2に、以上の理解を前提として、漁業分野における予防概念の展開の特質を、持続的利用といった他の「原則」との相互作用の観点から把握し、漁業条約体制の実証的検討を通じて「原則」間の調整規則の発展を明らかにした。そしてこれらの調整規則の発展は、条約体制で発展する規則の正当性を維持し、その実効性を高めるという意義をもつと同時に、「決定規範」としての予防概念の適用に関する予見可能性を向上させるという意味で、法的確実性の維持という観点からも車要な意義を有することを明らかにした。以上の研究成果は、「条約解釈における予防概念の規範的意義」並びに「海洋生物資源における予防概念の展開」として平成19年度に公表する予定である。特に前者については、英文での公表も予定している他、環境法政策学会での報告が既に決定している。
