昨年度に引き続き、本年度も、博士論文「戦間期における少数者の保護-少数者問題と常設国際司法裁判所-」の執筆に取り組んだ。一国の国内における「人種(ないしは種族)的、言語的、宗教的少数者」の保護は、国際法におけるもっとも古くからの関心事項であったし、現代においても、世界のありとあらゆるところで「少数者」の保護をめぐっては争いが絶えない。本研究では、戦間期の少数者保護制度に焦点を当てる。なかでも、分析の素材として、少数者の保護に関する常設国際司法裁判所(PCIJ)の判決・勧告的意見を取り上げる。現代の国際法学における少数者の保護は、第2次世界大戦後の「人権」概念をもって説明される。戦間期の少数者保護制度は、「人権」の課題の一つとしての「少数者(マイノリティ)の保護」の前史として簡単に記述されることはあっても、それ自体が研究の対象とはされてこなかった。一方、国際政治学の文脈では、国際連盟の「失敗」として戦間期の少数者保護制度についての研究がなされてきた。本研究の意義は、国際連盟の司法的機関であるPCIJの事例を分析し、これまで国際法学が焦点を当ててはこなかった戦間期における少数者の保護の法的な側面を描写することにある。本年度は、PCIJの事例の分析を踏まえて、東欧諸国での農地改革と少数者の問題と教育における少数者の権利の問題を抽出した。これらの問題を検討することにより、戦間期における少数者の保護のなかに、現代の国際法学における「人権」概念ではなく、少数者の保護というヴェールに包まれた、主権と少数者の相克、すなわち、少数者保護制度に内在する「国家」対「国家」の構図を読み解いた。そして、第2次世界大戦後に少数者(マイノリティ)の保護の条項が人権条約に設けられた経緯を考察し、戦間期における少数者の保護と「人権」概念の間には断層があることを明らかにした。
