项目摘要

本研究は,法整備支援(legal assistance)の手法による国際協力が,国家秩序の構築を介して,平和的な国際社会秩序の形成にどのように寄与しうるか,それによって形成されうる国際社会秩序の内容がどのようなものとなりうるかについて,国際機関・政府・NGOを中心主体とする実際の法整備支援活動を分析しながら考察した。そのプロセスを題材にして,制度改革と社会発展との関係に関する体系的理論の枠組みを試論的に提示し,国家における良い統治の構築が,地球的統治としての国際秩序の基盤になるという観点から,法整備支援の戦略的活用の意義を検証した。

This study examines the methods of legal assistance, international cooperation, the construction of national order, the formation of peaceful international social order, the content of international social order, and the analysis of legal assistance activities of international agencies, governments, and NGO. On the theme of the reform of the system and the relationship between social development and development, the theoretical organization of the system, the construction of good governance in the country, the governance of the earth and the foundation of the international order, and the significance of the application of legal support strategies.
