今年度は、前年度後半に引き続き、「負債に溺れた者」という法的概念に関する研究を行った。その結果は5月に開催された日本中東学会での口頭報告、7月イギリスのリーズで開催された国際中世学会での口頭報告、そしてIslamic Law and Society誌に投稿予定で現在英文校正中の論文という形で報告する。概略としては以下のようになる。日本中東学会では、ある人物が不正に他人の財産を取得したとき、彼にその本来の所有者に対して特殊な債務が発生するとみなし、この負債とこの人物の積極財産との関係によっては彼は「負債に溺れた者」として財産の処分権に制約を受けるものとする、中世マーリク派の法学説の概略とその歴史的な発展について論じた。国際中世学会では、14世紀モロッコの古都フェズの都市社会において、一部の集団が「負債に溺れた者」とみなされ攻撃を受けたという事例を紹介した。そして、これらの集団が実際には王朝の不正な徴税に関与していた人々であることから、上記の社会的な対立は、実際には、国家の徴税政策をめぐる王朝と都市民の対立を反映したものではないかという見解を示した。そして上記論文では、両者の議論を総合して論じた。上記の議論で取り上げた事例は、近世初頭のモロッコ農村社会で起きた事件を直接扱ったものではない。しかし、2016年度の研究で論じたように、中世のフェズを中心とした都市の法学者らによって議論された法的問題は、農村部出身で都市で学んだ後代の法学者らによって取捨選択されながら、農村社会にも適用されていったと考えられる。本研究の研究課題との関連でいえば、マーリク派イスラーム法学の古典的な学説が、近世初頭のモロッコ農村社会の法的規範に採用されていく過程の一例を、「負債に溺れた者」という概念に即して明らかにすることができた。

This year, the second half of the previous year, the concept of "liability" and "law" were studied. The results were presented orally to the Japan Middle East Society in May, orally to the International Middle East Society in July, and scheduled for submission to the Islamic Law and Society Journal. A brief description of the following is given. The Middle East Society of Japan is concerned about the acquisition of property by other people, their original owners, the creation of special debts, the disposal of property, and the development of legal theories in the Middle East. The International Society of the Middle Ages introduced some examples of "debt victims" and "attack victims" in the 14th century. The government of the People's Republic of China has made great contributions to the development of the country's economy. The discussion of the paper is comprehensive. The above discussion takes the example of the beginning of modern times, the beginning of rural society, the beginning of the event, the beginning of the event. In 2016, the study was conducted in the middle of the country, urban legal scholars from the middle of the country, urban legal scholars from the middle of the country, and rural legal scholars from the middle of the country. The research topic of this study is related to the classical theory of law, an example of the process of adoption of law in rural society at the beginning of modern times, and the concept of "liability".
