项目摘要

1.学会発表(Asian Law Institute, Inaugural Conference,2004年5月27、28日於シンガポール国立大学)報告タイトル:Is Legal Tradition Sacred to Be Immutable? : Conversion to Islam under Malaysian Family Law from the Viewpoint of Civil Courtマレーシアでは、コモン・ロー、イスラーム法、マレー・アダット及び先住民の慣習法が裁判規範として認められ、このような法制度は「多元的法体制」(M.B.フーカー)と称されている。主として、家族法の領域において、宗教及び民族ごとに異なる法が適用される結果、人際法の問題が生じることとなる。本報告では、非ムスリム婚の当事者の一方のイスラームへの改宗を原因とする離婚に焦点をあてて、マレーシアの法だけでなく政治においても、特別な意義をもつイスラーム法伝統の不変性/可変性について、通常裁判所の判例分析に基づいて、しばしば真正性が法、政治において強調されるイスラーム法が、多民族の共存の文脈では、不変性を必ずしも維持しえないことを明らかにした。2.「マレーシア法」、北村一郎編『アクセスガイド外国法』(東京大学出版会、2004年)所収マレーシアでの留学経験及び調査に基づいて、マレーシア法の基本的な調べ方についての解説を行った。3.「マレーシア・イスラーム離婚法の改革の法理とジェンダー」(博士論文、名古屋大学大学院国際開発研究科提出)これまでの研究及び調査に基づいて執筆した。イスラームでは「男女は神の前では平等であるが、男女間の役割は異なる」と言われ、イスラーム家族法では、ジェンダーの役割分担に基づく権利義務が付与されている。本論文では、マレーシアで適用されているイスラーム離婚法が、このようなジェンダー役割に基づいていることを前提として、過去40年間の法変動について分析し、そこにみられる改革の法理を明らかにすることを試みた。
