项目摘要

本年度は当初の研究計画を変更し、（A）都市の社会構造ではなく、（C）裁判制度に関する研究を行った。「近代中央ユーラシア地域における帝国統治の比較法制度・法社会史的研究」（基盤研究(B)・研究代表者：堀川徹）に基づく「第7回近代中央ユーラシア比較法制度史研究会」での研究発表の依頼があったことが、計画変更の主な理由である。まず、7月3日に行われた上述の研究会において、「ロシア帝政期南東コーカサスにおける法制度の変遷」という題目で研究発表を行った。さらに12月4日の「第7回近代中央ユーラシア比較法制度史研究会」において、研究発表「ロシア帝政期南東コーカサスにおけるシャリーア法廷の「仲裁」」を行い、同名の論文を上述の科研の報告書に投稿した。これは、ロシア帝国統治下の南東コーカサスにおいて、旧来のシャリーア法廷が裁判権を公式には剥奪されながらも、「仲裁」という形式をとりながら実質的な「判決」を下していたことを明らかにしたものである。これは、ヴォルガ・ウラル地域や中央アジアといった他のロシア帝政下イスラーム地域には見られない特徴である。また、上述の制度が確立するまでには様々な紆余曲折があったことが明らかとなり、南東コーカサスが中央アジアにおける新制度導入の試金石となっていた可能性があることも分かった。これらは、ロシア帝国の異民族支配のあり方に新たな視座を提供している。また、南東コーカサスにおける「イラン性」が、法の運用の面でも残存していたことも示している。8月29日から9月16日にかけては、アゼルバイジャン共和国バクー市での資料調査を行った。同国国立歴史文書館において、19世紀の裁判所に関わる多数の文書を閲覧し、画像データを入手することができた。また、多くの研究書や刊行資料を現地の図書館、書店で入手することができた。
