本研究は、①同意に基づかない撮影行為及び撮影データの拡散にかかる行為の処罰に関する研究、②撮影データ及び複製物の没収・消去の手法に関する研究に基づき、盗撮行為等による被害を有効に防止できる刑事法制について、理論的・立法論的検討を加えるものである。前者①は、現在、同意なく他人を撮影する行為について法律レベルでは処罰規定が設けられていない点にかんがみ、外国法の状況を参照しつつ、立法論的な提言を目指すものである。また、後者②は、データやその複製物の没収・消去の在り方について、現行法の没収規定で対応可能な範囲を明らかにした上で、付加刑としての没収の対象物件の拡張、さらに有罪判決を前提としない剥奪処分の可能性について理論的な検討を加えようとするものである。本年度（2022年度）の研究においては、研究代表者が法制審議会刑事法（性犯罪関係）部会の委員として議論に参加していることもあり、同部会の議論と並行するかたちで、新たな立法の在り方について、具体的な検討を進めた。同部会は審議の結果、性的姿態の撮影・拡散に関する新たな罰則、さらに、盗撮した画像データ等の没収・消去にかかる新たな立法を提言するに至った。これらの内容は、この間の研究代表者の研究成果とも基本的に符合する内容となっているが、改正法案の具体的内容については十分に明確にされていない点もある。今後の国会審議の状況を精査しつつ、改正法案の解釈論的な帰結、さらに、今後の立法論的課題について明らかにすることが重要な課題である。
