项目摘要

本年度は、二次文献・刊行史料の調査を続行するとともに、渡独して、レーゲンスブルクおよびバンベルク関係の史料収集を行った。前者については、ミュンヘンのバイエルン州立中央文書館で復讐断念誓約文書(ウアフェーデ)などを、後者については、バンベルクの州立文書館および市立文書館で都市裁判所の判決や都市参事会の審議録などを、閲覧・収集した。前年度に調査・収集したニュルンベルク関係の史料も含め、未公刊史料の十分な分析にはなお時間が必要であるが、今のところの一応の見通しは以下のとおりである。三都市とも、中世的な当事者訴訟から逸脱する性格を含む刑事裁判を展開したが、市内の裁判権関係が複雑なレーゲンスブルクやバンベルクに比して、ニュルンベルクにおいて、都市参事会主導の刑事裁判が最も明瞭であり、参事会と学識法曹の関係も、鑑定意見の請求などを通じて、最も密接であった。法規範における重い刑罰と、実際の裁判や刑の執行における減刑や赦免という、規範と実行の乖離は三都市共通に認められ、更に、市民に対しては刑の軽減などがなされる一方、非市民に対しては相当厳格な態度で臨むという点も共通する。このような態度は都市内部にとどまらず、15世紀の終わり近くになると、市外の貴族が都市や個々の市民に対して行うフェーデを、一般的に犯罪視して、その参加者の逮捕・処罰をめざす傾向が強まる。この傾向も、14世紀以後活発な経済活動を展開していたニュルンベルクにおいて、最も強く見られた。都市側のこうした態度が、刑事裁判の手続化をめざす近世の刑事裁判立法の成立に、貴族たちが重要な役割を果たしたことの一つの背景をなしたものと思われる。
