项目摘要

行政組織に必須の構成原理は民主主義原理であり、この原理のみを基にすると、ヒエラルヒー型の組織が望ましいことになる。しかし民主主義原理は行政組織の唯一の構成原理ではなく、次のように、他の構成原理も考慮すると、むしろ一定の独立性を持ち、それぞれの特性に適合した異なる組織形態を備える、行政組織が望まれることになる。第1に、権力の濫用を防止するという意味の古典的権力分立原理に基づき、独立性を認められる機関(警察および公安委員会等)。第2に、機能分立原理に基づき、分立が要請され始めた、政策の企画立案部門と実施部門、および過度の分離の反省により整備され始めた、省庁間調整機構。第3に、国が社会の自律的領域を保全する、またはそれと協働するという意味の法治国原理に基づく、自治組織、委員会、審議会等。第4に、国と他の社会組織に共通する効率性の要請を、主要な行動原理とすべき行政組織、すなわち公企業等。近年の行政改革は、以上のような行政組織の多様な構成原理および組織形態を意識させた点で、行政組織法理論も改革する重要な契機といえるが、独立行政法人を巡る議論のように、異なった構成原理を混同した議論も見られる。さらに目下、行政組織に対応する公務員の制度について、行政組織改革に対応する形で、官民あるいは産官学の交流を促進する法改革が進行している。そこで今後は、公務員の「全体の奉仕者」性を考え直し、公務員の交流と身分の多様化について、意義と限界を研究したい。
