Rethinking changes and regional differences in Chinese legal culture

在本研究期间，以下事实得到了证实。第一，宋代的法律的文化与明清唐相比有其独特之处，即在县权相对薄弱的明清时期，民事法律的需求并不强烈，但在宋代，有关土地交易和财产权的法律却不少。唐代的“鲁”是按照均田制设计的，禁止私人买卖土地。二是日本镰仓时代早期的一些法律，特别是关于时效地役权的规定，极有可能是源于宋代法律。

During the term of this research, the following facts have been proved. First, the legal culture of the Sung dynasty was unique in comparison with those of Ming, Ching and Tang.Namely, civil laws were not strongly demanded in Ming and Ching when the power of countieswas relatively weak, but in Sung there were not a few laws regarding land transactionand property rights. In Tang, the lu was only designed in accordance with equal fieldsystem, where private transaction of land was prohibited. Two, some laws in the early times of Japanese Kamakura period are highly probably stemmed out from the Sung laws,especially regarding easement by prescription.
