项目摘要

未成年子の教育についての親(家庭)と学校の役割分担を究明することを目的として, 民法における監護教育条項の規定過程を考察した結果, 次の知見が得られた.1.明治11年民法草案における監護教育条項現行民法の監護教育条項(820条)に相当する明治11年民法草案の第178条は, 婚姻に伴う夫婦の義務のひとつとして「子ヲ養育教訓」する義務を規定した. この「養育」は身体的育成を, また「教訓」は親が事実行為として行う徳育および知育を意味していた. この規定は, ナポレオン法典の第203条にならったものであった.2.旧民法の編纂過程における監護教育条項明治21年に起草が完了した民法草案人事編の第一草案における親の教育義務条項は, 子の体育, 徳育, 知育を親みずからが包括的に遂行する義務と, その知育義務の一環として子を就学させる義務を内実としていた. しかし, 本条項は, その後の法案審議の過程で削除された.3.明治民法における監護教育条項現行民法の第820条に踏襲された明治民法の監護教育条項は, 親権条項の起草を担当した梅謙次郎が, ナポレオン法典の影響が濃厚であった旧民法第一草案の起草者意思に沿い, かつドイツ民法草案の関係条項を参照して起草した原案に即して規定された. この民法上の親の教育義務は, 体徳知の三育を行う義務としての親の子に対する事実行為義務にとどまり, すでに公法たる小学校令によって規定されていた就学義務とは別個のものとして規定されたのである.
