项目摘要

考案した監護教育条項の解釈論とは、民法親族編の親権条項のうち、現行規定の第820条と、その旧規定である明治民法の第879条についてのものである。1.解釈論の考察旧規定下の多数説においては、親の監護教育権のうち、教育的側面にかかわる権利は、子に受けさせる学校教育の種類と程度、職業教育の種類、宗教教育の宗派について決定する権利であり、公法上の義務である就学義務とは別個の、親の子に対する私法上の権利とされていた。現行規定の解釈論においても、私法義務説が多数説となっているが、学校の教育内容について、子の権利の代行者としての親の権利が留保されているとして、公教育を親の教育義務を補完するものととらえる説がある。この補完義務説は、その義務の履行程度の判定方法や履行強制の方法について明確さを欠いている。2.結論監護教育条項の沿革から見た場合、民法上の親の監護教育権は、親が子に対して体育・徳育・知育を包括的に行う教育義務と、その義務を履行するために親が行う指示に子を従わせる権利とを意味している。したがって、義務教育段階の子は、親が、民法上の監護教育権にもとづいて内容と方法を自由に決定して実施する私教育と、公法上の就学義務を履行する事によって成り立つ公教育という、法形態を異にする二つの根拠規定にもとづく教育作用を受ける権利を有している。この二つの教育作用を理念的に止揚する実定法規は、教育基本法の第1条だけである。
