3年目の本年は、主に2つの研究課題を設定し、それぞれ以下のような成果をえた。まず、GATT体制下のセーフガード制度の理論的な把握のために不可欠である一般国際法上の事情変更原則について研究し、以下の論証を行った。(1)同原則の法的根拠をめぐって、いまなお実行上及び学説上多大な見解の相違があるということ、(2)しかし、同原則に関する実行及び学説の歴史的な検討、また国際法委員会における法典化作業の検討によれば、同原則は古くから、そしていまなお、国内契約法上の事情変更原則と同様に合意当事国(者)の合理的な期待の実現を目的とした法原則として理解されるということ、(3)この点、同原則は2国間の契約的関係の総体としての性格を有していたGATT体制においても適用可能な法原則であったと考えられ、GATT体制下のセーフガード制度は同原則の特別法に相当する制度として理解されるということ。次に、本研究の主題であるGATT/WTO体制下のセーフガード制度の歴史的な展開と意義について研究し、以下のような理論枠組みを構築した。(1)2国間通商条約によって規律された19世紀及び20世紀の国際自由貿易秩序においては、事情の予見されなかった発展による国内産業への損害は事情変更原則の適用を通じた条約の終了により対処されていたということ、(2)GATT体制下においても国際自由貿易秩序は依然として2国間の契約的関係の総体としての性格を有し、事情の予見されなかった発展による国内産業への損害の救済について規律したGATT19条は事情変更原則の特別法としての性格を有していたということ、(3)GATT体制からWTO体制への移行にともない国際自由貿易秩序は自由貿易の実現を目的とした公法的秩序としての性格を色濃くし、セーフガード制度もセーフガード協定の成立にともない経済効率性の増大を目的とした実体的な権利規定へと変容したということ。今後前者の成果を研究論文にて発表し、後者の成果を博士論文にまとめる予定である。
