项目摘要

本研究の目的は、日本国憲法制定当時に「文化」についてどのような議論がなされていたかを明らかにすることで、日本国憲法下で文化政策を論じる基本的な前提を確認し、もって日本社会に根ざした基本的人権として文化権概念を構築し保障していくための出発点とすることである。今年度は日本国憲法の成立過程のプロセスで「文化」あるいは「文化国家」とい国憲法の成立を法制定・公布における「文化」をめぐる議論を軸に憲法制定過程を整理し直して論文にまとめた(現在投稿・査読中)。戦後当時「文化」は敗戦国日本だけでなく占領したアメリカも言及したが、その用法は一様ではなかった。敗戦直後に成立した東久邇宮内閣では「文化」という言葉をかなり積極的に発言しており、官僚レベルのかなり早い段階での憲法改正の検討でも文化に関する指摘はなされていた。憲法策定の公式のプロセスで文化をめぐる議論が活発化するのは草案作成以降、主に議会の議論においてであり、政府案作成の議論よりも民間草案の方が「文化」に関する論点を提示していた。帝国議会では「文化国家」、「文化」「民主主義」「平和」「教育」といった言葉が頻出し、重要性が指摘された。そして節目節目の勅語でも「文化」は語られていた。最終的に条文に反映されたのは25条1項の生活水準に関する「文化」のみであったが、それ以外でも「文化」に関しては貴族院における「芸術の自由」をはじめとする様々な議論が行われ、その中には通常の行政とは別の「特別ノ美術行政ニ相應シイ機構ヲ考ヘナケレバナラナイ」という発言をはじめ現代の文化政策に通じる問題意識もうかがえる。今日の日本社会の秩序が形作られていった憲法制定過程において、すでに文化に関して多様な議論が行われていたことが明らかになった。以上をまとめた論文の内容については、本年度に実施した学会発表の場でも紹介している。
