本研究は、ラテンアメリカの実践に端を発する移行期正義（独裁または紛争後における過去の人権侵害や戦争犯罪の清算）の実践が、国際的な場で定式化され、それがラテンアメリカに「逆流」してきたときに、もともと移行期正義の実践に携わってきた人々（主として被害者団体と人権NGO）がそれをどのように受け止めたのかを、アルゼンチン、チリ、ペルー、コロンビアの4ヵ国を対象として探るものである。令和4年度は、いまだ海外調査が困難であったこともあり、日本で入手可能な文献を用いて研究を進めた。文献資料では、断片的ながら、国際的専門家によって定式化された「移行期正義」に対する人権侵害被害者の態度をある程度見て取ることができた。アルゼンチンでは、被害者の粘り強い努力の結果、人権侵害加害者の訴追がラテンアメリカで最も進んでいる。アルゼンチンの人権侵害被害者及びその家族は、「移行期正義」を和解の名の下に司法的正義の実現を阻むものと捉えており、そのためにこれを拒絶する態度が支配的である。コロンビアでは、2000年代に当時の右派政権が極右民兵に大幅な免責を与えて非武装化しようとしたとき、すでに国際的な場で成立していた「移行期正義」を口実にした。極右民兵や治安部隊の人権侵害の被害者（その多くは左派）はその試みに反対して組織化した。2010年代には逆に、政府が左翼ゲリラFARCとの和平合意において大幅な免責を与える仕組みを作った。2000年代の「移行期正義」に反対した左派系の勢力は今度は賛成に回り、かつて極右民兵への免責を推進した右派勢力は逆にFARCへの「厚遇」を非難した。ペルーとチリの被害者の態度については、これまでのところ文献で充分な情報が得られていない。
