民間工事において使用されてきた四会連合請負規程・約款は、大正12年の作成以降昭和56年の改訂までに9(戦前4、戦後5)つがある。公共工事標準約款は、戦後、公共工事の統一モデル約款として、四会連合約款・物価庁契約書案・アメリカ標準契約書を参照して昭和25年に作成され、平成元年までに7回の改正がなされた、今年度は、これらを収集し、各条項の変遷を比較検討した。この結果、以下のことが判明した。(1)大正12年の四会連合作成の工事請負規程は、明治44年の建築学会決定の建築請負規程(明治31年の辰野金吾作成の日本銀行大阪支店一式請負人心得の影響あり)や大正3年の建設業協会作成の請負規程(ドイツ・スイスの契約書をも参照)を参照しつつ、鳩山秀夫の査閲を経て決定された、(2)昭和8年改正の請負規程には労働者災害扶助の条項が加えられた、(3)昭和18年及び19年改正の請負規程では、危険負担条項が戦時下の事情を考慮して改正された、(4)戦後初改正の昭和26年約款は、中央建設審議会との共同研究により作成され、民間建設工事標準請負契約約款(甲)と同一内容であった、(5)昭和32年及び昭和50年の改正は、全般にわたる内容整理を行い、設計の疑義・条件の変更、工事中止、工事用地、第三者損害、暇疵担保等に改正がなされた、(6)紛争解決条項は、戦後の改正で毎回修正がなされてきた、(7)公共工事では、戦前から契約の片務性克服が主張され、戦後も、代理受領制度、スライド条項、前払金保証制度・履行保証保険制度、請負人の異議申出権、ボンド制度などの導入、規制緩和に伴う指名競争入札制度の改善など多様な試みがなされている。
