本年度の研究は、(1)日本における国際人権法の実態(国際人権条約の国内的実施状況)把握と、(2)日本における国際人権法の理論構築に対して有用な視点・理論的枠組を得るために諸外国の研究を検討することを中心として行った。(1)、(2)の双方に必要な文献・資料を収集すると同時に、(1)の点に関しては、データベースおよび既存の個別的研究を参考にして、国際人権法に関係する事件を収集すると同時に、事件の特徴、問題点、解決の有無などについて分析を行い、人権の「国際化」の現状把握を行った。そして、日本の国際人権保障について、自国内完結型(自国の人権基準を国際基準並にすることで完結)、国際世論依存型(日本政府側から見ると世論回避型)という特徴を明らかにした。また、(2)の比較法的視点から、(1)の日本の特徴の理由の一つとして国際機関への個人申立制度の欠落(自由権規約選択議定書の未批准)を推論した。次に、(2)の点に関しては、国際人権保障機構として最も評価の高いヨーロッパ人権条約の実効性の要因の究明を行った。これについては、a)同条約を国内法化していないにもかかわらず、解釈の中に少しづつ取り入れ始めたイギリス裁判所の判決の検討を通じて、国内裁判所に及ぼす同条約の強い影響力を論証した。この点は、国際人権条約に一貫して消極的な日本の裁判所のあり方を検討する上で有益な示唆を提供する。次に、b)ヨーロッパ人権裁判所の判例の蓄積の結果、同条約機構として判例理論の構築、ひいては人権概念の探求が必要かつ可能であり、a)とも強い関連性があることを指摘した(a、bに関する研究発表は後述11参照)。今後、同条約についてはイギリス以外の国の検討を行い理論としての緻密さを高めると同時に、日本自体について詳細な検討を行い、(2)の成果を生かしつつ、日本における国際人権法の実効性を高める要因の究明と理論構築を進めていく予定である。
