项目摘要

裁判における事実認定は法的三段論法の小前提を構成し、その誤りは結論たる判決主文の誤りを論理必然的に惹起する重要な局面である、はずである。ところが国際裁判の文脈においては、この事実認定という局面は必ずしも注目されてこなかったばかりか、そもそも国際裁判においては証拠法のような問題にはあまり傾倒すべきではないといった主張すら見られるという議論状況であった。そこで、通説がこのような理解に至っているのはなぜであるのかを検討するために、国際裁判における事実認定と証拠の取扱いという局面の意義を明らかにしようとしたのが本研究である。具体的には、証拠法論の中でも特に議論の俎上に上ることの多い証明責任論と推定論を中心に、国際裁判における証拠法論の特質に迫ろうと試みた。従来的理解では、国際裁判における事実認定は〈客観的真実〉を志向するが故に、証拠法規則は〈柔軟〉であることが望ましいことがアプリオリに措定されてしまうことが多かった。本研究は、現実の裁判実行の検討を踏まえてこのような前理解そのものの妥当性を問い直そうとする試みである。その結果、国際裁判における事実認定は、〈客観的真実〉への到達という目的のための〈柔軟〉な法規則という単純な目的-手段の連関で把握しうるものではなく、〈適正な権利救済実現〉〈法的安定性〉〈司法運営の適正〉〈主権国家(による自己判断の)尊重〉といった様々な価値を調整する過程として把握され、そのために各種の判例法理が展開してきているものと捉えられることが明らかとなった。したがって従来的理解は修正を要するという方向に向かうのであるが、そもそもこのように現実の裁判実行と乖離した理解がなぜ形成・維持されたのかという問題が残る。これが研究者による次の課題であり、最終年度はそれに向けた学説・判例の整理を行った。本研究の成果は次の採択課題に引き継がれる予定である。
